Essay / Analysis of the Stand Your Ground Law - 1111
The Stand Your Ground Law states that it is a form of self-defense that gives people the opportunity to use deadly force to defend themselves. This is not the main problem of people who do not respect the basic law. People's distaste for the law comes from the way your basic law is used. What I mean by this is that some states have different meanings and interpretations of how your basic law can/is used. The decisions that entrenched Basic Law in the United States currently allow forty-six U.S. states to use this as a reasonable defense. (Shapiro, 2013) So where did this all start? Over a hundred years ago in Indiana, Runyon vs. State took place. He said the American people's way of thinking does not allow them to follow a rule that tells them to retreat, but that the person attacked or threatened cannot be at fault if they are in the right place at the right time. Thus, allowing him to defend himself using force, which allows him to exercise his right of self-defense. The reason retreat laws were enacted dates back to ancient British law when the deadly weapons used were swords, as swords allowed the defense to retreat, thereby reducing the amount of blood shed when fighting. altercation. British law reflects a “deference to the police” whereby the king had a duty of protection to his subjects. This is obviously not part of our tradition. (Shapiro, 2013) Despite what gun prohibitionists claim, the no-retirement rule has deep roots in American law. In the Supreme Court, the SYG dates back to the unanimous case Beard v. United States of 1895, in which Judge John Harlan affirmed the right to armed self-defense. (Weaver, 2008) It is difficult to talk about... middle of paper ... operational capacity to defend oneself, the victims will always be the victims of these crimes. Conclusion In conclusion, I have shown that even though your basic law may not be perfect, there are still many good things that come from it. My only suggestion to consider when developing a law like this is the ability of citizens to make the decision themselves without any training or prior knowledge on how force can and should be used in these cases. Our society is constantly growing and changing, hopefully for the better, but with these changes and new laws there will be mistakes and learnings. I hope I have convinced you to pass your basic law on the basis that yes, people are not forced to retreat as long as they don't do anything illegal, but at the same time they are trained to make these decisions or at least held to the same standard.
